These Terms and Conditions ("Terms") govern your access to and use of the Clevency website and services (collectively, the "Platform") operated by Clevency ("we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Eligibility
You must be at least 18 years of age to create an account or make a purchase on the Platform. By using the Platform you represent that you meet this requirement. The CFA Program has its own eligibility requirements set by CFA Institute; it is your responsibility to confirm you qualify to sit the exam.
2. Account registration
You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@clevency.com if you suspect unauthorised access.
3. Intellectual property
All content on the Platform — including but not limited to exam questions, explanations, diagnostic reports, study plans, text, graphics, logos, and software — is owned by or licensed to Clevency and protected by applicable intellectual property laws.
You may not reproduce, distribute, resell, publish, broadcast, or otherwise exploit any content from the Platform without our prior written consent. Sharing login credentials or exam content with third parties is strictly prohibited and will result in immediate account termination.
4. Purchases and payment
All prices are listed in US Dollars (USD) unless otherwise stated. Payment is due at the time of purchase. We use third-party payment processors; your payment information is handled directly by the processor and is not stored on our servers.
Access to purchased mock exams is granted immediately upon successful payment confirmation. Access is personal and non-transferable.
5. Refund and cancellation policy
All sales are final. Because mock exam content is delivered digitally and is immediately accessible upon purchase, we do not offer refunds once access has been granted. If you experience a technical issue preventing access to content you have purchased, please contact us at hello@clevency.com within 7 days of purchase and we will work to resolve the issue.
This policy does not affect any statutory rights you may have under applicable consumer protection laws.
6. Acceptable use
You agree not to:
- Share, publish, or distribute exam questions, answer explanations, or diagnostic outputs from the Platform in any form
- Attempt to reverse-engineer, scrape, or copy content from the Platform
- Use automated tools to access the Platform
- Misrepresent your identity or affiliation
- Engage in any conduct that disrupts or interferes with the Platform
- Use the Platform for any unlawful purpose
7. Disclaimer of warranties
The Platform and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that use of the Platform will result in passing the CFA examination. Mock exam performance is one input among many factors affecting exam outcomes. Pass rates depend on individual preparation, study hours, and many variables outside our control.
8. Limitation of liability
To the fullest extent permitted by law, Clevency and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform or its content, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
9. CFA Institute trademark notice
CFA® and Chartered Financial Analyst® are registered trademarks owned by CFA Institute. Clevency is not affiliated with, endorsed by, or approved by CFA Institute. Our materials are intended to complement, not replace, official CFA Institute curriculum and study resources.
10. Third-party links
The Platform may contain links to third-party websites. We have no control over those sites and are not responsible for their content or privacy practices. Links do not constitute endorsement.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Modifications to terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or by a notice on the Platform. Continued use after changes take effect constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms, without notice and without liability to you. Upon termination, your right to access purchased content ceases.
14. Governing law
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation in the first instance. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts.
